Update of ACRP LRD 34 "Airport Public Health Preparedness and Response: Legal Rights, Powers, and Duties"

TRB's Airport Cooperative Research Program (ACRP) Legal Research Digest 34: Airport Public Health Preparedness and Response: Legal Rights, Powers, and Duties addressed the legal issues concerning the measures to detect communicable diseases, regulations to control communicable diseases, methods for decontamination, emergency legal preparedness, privacy, and potential sources of liability.

This LRD was released in August 2018 and it should be updated based on the lessons learned from COVID-19.

The ACRP LRD 34 was released in August 2018 and it should be updated based on the lessons learned from COVID-19.

Objective--State the objective, including a brief description of the intended deliverable, which airport stakeholders are the intended audience, and how their needs will be met by the deliverable.

The goal is to provide an up-to-date checklist that airport attorneys and other staff can use to help prepare, plan, and coordinate with their partners in response to a threat of a communicable disease based on the lessons learned from COVID-19.

Relevance to Airport Legal Issues--ACRP's Legal Research Program focuses on legal and regulatory challenges and issues as they specifically pertain to airports. Please describe how this topic is relevant and unique to airports such that it should be researched.

Numerous legal issues are associated with these inherent challenges, but through planning and coordination with relevant stakeholders they can be addressed. The LRD 34 digest addresses the legal issues concerning the measures to detect communicable diseases, regulations to control communicable diseases, methods for decontamination, emergency legal preparedness, privacy, and potential sources of liability. The digest provides a checklist that airport attorneys and other staff can use to help prepare, plan, and coordinate with their partners in response to a threat of a communicable disease. This digest should be updated based on the lessons learned from COVID-19 and the several related legal issues that have arisen at individual airports as well as at the state and federal levels from this crisis.
